Here are the essential points concerning this consent:
Data concerned
Certain categories of data require your explicit consent before being collected or processed.
Consent procedures: Consent form: When we collect data requiring your consent, you are informed via forms.
Explicit consent is requested, here by ticking a box.
Safeguarding the vital interests of other personal data, in particular in the context of the dangers of the sea, health and disability and group life in a closed and close environment.
In the context of a maritime event such as The Tall Ships Races, certain situations may require the processing of sensitive personal data to ensure the protection of the vital interests of participants. This concerns in particular data relating to health, safety at sea, people with disabilities, and group life in an enclosed environment such as a ship.
Safeguarding vital interests refers to the processing of personal data to protect the life or physical integrity of an individual, particularly in situations where rapid intervention is required, for example in the event of a medical emergency or danger at sea. This type of processing is permitted without explicit consent when it is necessary for the survival and safety of the persons concerned.
In order to safeguard vital interests, the company we work with, Windseeker, may process the following categories of data:
- Health data: Basic medical information (allergies, chronic illnesses, current treatments) which may be essential in the event of an emergency. Emergency contact numbers for relatives.
- Disability Data: Information relating to the specific needs of people with disabilities, to ensure safe and appropriate access to activities on board and ashore.
- Group Living Data: Information on the ability to live together in a confined space, which may include psychological or social information essential to ensure a safe and harmonious group dynamic.
Personal data is processed for the following purposes:
- Emergency response: to ensure rapid and appropriate medical care at sea or on land in the event of an incident.
- Safety at Sea: to prevent accidents or incidents linked to health conditions or disabilities that could affect navigation or participation in activities.
- Facilities and Accessibility: adapting infrastructures and services (such as boats, cabins and equipment) to the needs of people with special medical or physical conditions.
- Harmonisation of Group Living: promoting harmonious cohabitation in a closed environment by taking into account the specific characteristics and needs of each participant, while guaranteeing the safety of all.
Data processed as part of safeguarding vital interests is only shared with parties directly concerned with the safety and health of participants. This may include:
- Crews and Safety Officers: these people may have access to information essential for ensuring safety at sea and coordinating assistance in the event of an emergency.
- Health Professionals: medical data may be shared with medical teams and emergency services, on land or at sea, to ensure appropriate care.
- Event organisers: organisers may process this data to adapt activities, infrastructures and services to the specific needs of participants.
Legitimate interest is one of the legal bases provided by the General Data Protection Regulation (GDPR) for the processing of personal data, where that interest is necessary for the pursuit of legitimate aims of the organiser or a third party, provided that this does not adversely affect the fundamental rights and freedoms of the individuals concerned.
In the context of the organisation of events such as The Tall Ships Races", the legitimate interest may justify the processing of certain personal data to ensure efficient organisation, guarantee the safety of participants and improve the user experience.
The reasons why we rely on legitimate interest to process some of your data are as follows:
- Safety and Protection of Participants: Process personal data to ensure safety at events, particularly in the event of an emergency situation, evacuation or to ensure the coordination of rescue at sea.
- Fraud and Infringement Prevention: using data to prevent or detect fraudulent activities, abuse or violations of event regulations.
- Logistical and organisational management: processing data to manage registrations, organise events, manage participant lists, allocate crews or resources (food, accommodation, equipment).
- Ensuring that the specific needs (health, disability) of participants are taken into account in the organisation of infrastructures and services.
- Improving the User Experience: analysing browsing behaviour on the site to improve navigation and optimise the content offered (most visited pages, optimising user paths).
- Event-related communications: using your contact details to send you essential information about the organisation of events, such as logistical updates, last-minute information or programme changes.
- Maintaining Online Security: using login data and IP addresses to ensure the security of the website, prevent cyber-attacks and ensure a secure user experience.
Legitimate interest cannot justify just any processing of personal data. A balancing test is necessary to ensure that this legitimate interest does not infringe your fundamental rights and freedoms. We take the following measures to ensure this balance:
- Transparency: You are informed about the collection and use of your data and the purposes for which it is processed. This is essential so that you can understand why your data is needed for these purposes.
- Proportionality: We limit the collection of data to that which is strictly necessary for the legitimate interest in question. The information collected is only used for the specific purpose for which it was collected.
- Users' rights: You have the right to object to certain processing operations based on legitimate interests. If you exercise this right, we will have to demonstrate why the processing of this data is essential or cease processing.
Examples of Data Processed on the Basis of Legitimate Interest
Here are some concrete examples of data that we process on the basis of legitimate interest and in what context:
- Contact Data (e-mail, telephone): Used to send essential information about the event (changes, alerts, etc.) or post-event satisfaction surveys.
- Safety Data (certifications, physical abilities): Processed to check that participants meet the necessary criteria for safety at sea (maritime certifications, state of health).
- Technical Data (IP address, connection logs): Used to monitor site security, prevent unauthorised access and detect potential cyber attacks.
- Participation Data (crew allocations, registration forms): Used to ensure the smooth organisation of the event, allocate roles and optimise logistics (accommodation, food, etc.).
We take rigorous measures to ensure the security of sensitive data. Information collected for the purpose of safeguarding vital interests is treated with a high level of confidentiality and stored securely via Windseeker. Only authorised and trained personnel have access to it.
Measures include :
- Restricted Access: only people who need to know this information for security or health reasons have access to the data.
- Data Encryption: sensitive data is stored in encrypted systems, ensuring protection against unauthorised access.
- Limited retention: data relating to the safeguarding of vital interests is kept only for as long as is necessary to manage risks and ensure the safety of participants. It is deleted or anonymised as soon as the situation allows.
Even in the context of safeguarding vital interests, you have certain rights concerning your personal data:
- Right of Access: You have the right to ask to see the personal data we hold about you.
- Right of Rectification: If your information is incorrect or incomplete, you may request that it be corrected.
- Right to Limitation: You may request a limitation of processing if you consider that the data is not necessary or is being used inappropriately, unless processing is vital for your safety.
However, these rights may be limited in certain emergency situations where the protection of life or safety is paramount.
Safeguarding vital interests is a priority in events involving maritime risks and closed environments. Sensitive data, such as medical information, is processed with the utmost care, respecting the rights of participants and the regulations in force.
